Terms of Service

These terms are the agreement between JobsiteBooked ("we" or "us") and you. By using our website or our services, you agree to them. If you don't agree, please don't use our website or services.

Who these terms apply to

Businesss on our plan. If your business signs up for JobsiteBooked, these terms apply to your business and to everyone who uses our services for it. Whoever signs up confirms they're allowed to agree to these terms for the business. In most of these terms, "you" means the business.

Website visitors. If you're just visiting our website, the parts of these terms about using our website apply to you, along with our privacy policy.

Texts we send, and texts businesses send through our software, are also covered by our SMS terms.

Our services

JobsiteBooked gives contractors and trade businesses in the US one monthly plan for running their jobs. It includes the following.

Booking and requests. An online booking page and request form, a website if you want one, and missed-call text back.

Estimates and jobs. Estimates with options that customers can sign online, follow-ups on open estimates, scheduling and dispatch, recurring jobs, and a crew page with each day's jobs, checklists, photos and time.

Invoices and payments. Invoices, online card and bank payments, and payment reminders.

Reviews and messages. Review requests, arrival texts, and one inbox for texts, email and social messages.

Setup and help. We set the software up for your trade and your crew, and help you when you need it.

We may change, add or remove features over time. If a change takes away something important in your plan, we'll let you know ahead of time.

Getting started

We aim to have everything set up and running 14 days after our first call. That depends on getting what we need from you on time, such as your logo, photos, business details and access to your accounts.

Billing and canceling

Month to month. Your plan runs month to month. There's no contract and no minimum term.

No setup fee. We quote your price on a call before you sign up, and that's what we bill each month. There's no setup fee.

Paying. You agree to pay each monthly charge when it's due. Prices don't include taxes unless we say so. If a payment fails and isn't fixed, we may pause your services until it is.

Price changes. If we ever change your price, we'll tell you ahead of time, and you can cancel before the new price starts.

Cancel anytime. You can cancel whenever you like by emailing hello@jobsitebooked.com. Canceling stops future charges. Your services keep running until the end of the month you've already paid for, and we don't refund partial months.

Payment processing

Card and bank payments from your customers go through the payment processor you connect, such as Stripe, under its own terms. The processor charges its own fees for them.

Your content and customer data

You own your content. Your logo, photos, words and anything else you give us stay yours. You let us use them to provide our services to you, such as putting them on your website and in your ads. You confirm you have the rights to everything you give us.

You own your customer data. Information about your customers, jobs and invoices belongs to your business. We handle it for you, as your service provider, under the agreements we have with you. Our privacy policy explains more.

What stays ours. The software, templates, designs, tools and know-how we use to provide our services belong to us or to the companies we license them from. Using our services doesn't make them yours.

Your responsibilities

Accurate information. Give us accurate, up-to-date information about your business, and tell us when something changes. You're responsible for checking that your website, profiles and ads are accurate.

Customer consent for messages. Before you text, call or email customers through our software, get the consent the law requires. Follow the texting and calling laws, including the Telephone Consumer Protection Act, and the carriers' rules. Stop messaging anyone who asks you to stop. Don't make agreeing to marketing texts a condition of service or of buying anything.

Advertising and licensing rules. You're responsible for making sure your website, estimates and messages follow the rules for your trade, including the FTC's rules on truthful advertising and your state's contractor licensing rules. Don't make claims you can't back up, and get the permission the law requires before using a customer's name, photo, review or story.

Your own privacy duties. You're responsible for your own privacy notice to your customers, including making sure it covers the tools you use with us, such as texting, payments and website tracking.

Your work decisions. How you price, schedule and do your work is up to you. Reports and AI features help you work, but they don't replace your judgment. Check the work of AI replies, and tell customers they're talking with AI or being recorded wherever the law requires it.

Your logins. Keep your logins safe, give access only to people at your business who need it, and tell us right away if you think someone got in who shouldn't have. You're responsible for what happens under your accounts.

Results aren't guaranteed

We'll do our best work for your business, but we can't promise specific results, such as a number of new customers, bookings, calls, reviews or search rankings. Results depend on things we don't control, including your market, your ad budget, how your team follows up, and how Google, Meta and other platforms work. Results aren't guaranteed.

Using our services the right way

Don't use our website or services to send spam or messages people haven't agreed to get, to break any law, to mislead people, or to post anything harmful, hateful or that you don't have the rights to.

Don't try to get into systems or accounts you're not allowed into, copy our services, sell access to them, or disrupt them for anyone else.

If you do, we may suspend or end your services. We'll usually warn you first, unless the problem is serious or we need to act quickly.

Other companies' platforms

Our services work with platforms run by other companies, such as Google, Meta (Facebook, Instagram and WhatsApp), TikTok, and phone and texting carriers. Parts of our services also run on software from other companies. Your use of those platforms is also covered by their own terms and policies.

We don't control those companies. They can change features, turn down or remove ads, limit reach, suspend accounts or stop working, and we're not responsible when they do. When something like that affects your business, we'll help where we can.

Limitation of liability

To the extent the law allows, we provide our website and services "as is" and "as available", and we make no promises about them beyond what these terms say, including any implied promise of merchantability, fitness for a particular purpose or non-infringement. We don't promise our services will always be available or free of errors.

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, customers, data or goodwill, even if we knew they were possible. Our total liability for all claims connected to these terms or our services is limited to the amount you paid us in the three months before the claim came up.

Claims from your use. If someone makes a claim against us because of your content, your ads, messages you sent, or your breaking these terms or the law, you'll cover our reasonable costs from that claim, including legal fees.

Some states don't allow some of these limits, so they may not all apply to you.

Ending the service

You can end your service anytime, as explained under "Billing and canceling". We can end it by letting you know ahead of time, or right away if you don't pay, break these terms, or use our services in a way that puts us, your customers or others at risk.

When your service ends, your access to our software and services stops. Before your last day, you can ask us for a copy of your customer data and content, and we'll help you get it. We handle any customer information we still hold as our agreement with you and the law require.

The parts of these terms that should last after the service ends still apply, such as payments owed, ownership and limits on liability.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the date at the top of this page, and we'll let clients know about big changes by email. If you keep using our services after a change takes effect, you're agreeing to the updated terms. If you don't agree, you can cancel.

If you have a problem, please contact us first so we can try to sort it out.

A few more things

These terms, our privacy policy, our SMS terms and anything we agree with you in writing about your plan make up the whole agreement between us. If you've signed a separate agreement with us, such as one about customer information, that agreement wins where the two disagree.

If part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. You can't transfer these terms to someone else without our written okay. We can transfer them if our business changes hands.
